Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AI Voice Assistant service operated by Kjek ("Kjek," "we," "us," or "our") at kjek.com (the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher) to use the Service. You must provide accurate registration information and keep your account credentials secure. You are responsible for all activity that occurs under your account.

Kjek provides an AI-powered voice assistant that lets you speak to an assistant, receive text and spoken responses, and view your conversation history. The Service uses third-party technologies including speech recognition, language models, and text-to-speech synthesis.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee uninterrupted or error-free operation.

Access to the Service requires an account authenticated through Auth0 or another identity provider we support. You agree not to share your login credentials, impersonate others, or create accounts through unauthorized means.

We may suspend or terminate accounts that violate these Terms or pose a security or legal risk.

You agree not to use the Service to:

• Violate any applicable law or regulation;
• Infringe intellectual property or privacy rights of others;
• Harass, threaten, defame, or harm others;
• Upload or generate unlawful, abusive, hateful, or sexually exploitative content;
• Attempt to gain unauthorized access to systems, accounts, or data;
• Probe, scan, or test vulnerabilities without authorization;
• Reverse engineer, scrape, or automate access except as permitted by us;
• Interfere with or disrupt the Service or its infrastructure;
• Use the Service to provide medical, legal, financial, or other professional advice without qualified oversight;
• Misrepresent AI-generated output as human-generated where doing so would be deceptive or harmful.

Using voice features requires granting microphone access in your browser. You are responsible for ensuring you have the right to record in your environment and that you do not record others without their consent where required by law.

Responses from the assistant are generated automatically and may be inaccurate, incomplete, outdated, or inappropriate. The Service is provided for general informational and productivity purposes only.

You are solely responsible for evaluating and using AI-generated content. Do not rely on the Service for decisions that could result in injury, loss, or legal liability. Always verify important information independently.

You retain ownership of content you submit through the Service, including voice recordings converted to text and written messages ("User Content"). You grant Kjek a worldwide, non-exclusive, royalty-free license to use, store, process, and transmit User Content solely to operate, provide, and improve the Service, including sharing with subprocessors as described in our Privacy Policy.

You represent that you have all rights necessary to submit User Content and that it does not violate these Terms or applicable law.

The Service, including its software, design, branding, and documentation (excluding User Content), is owned by Kjek or its licensors and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features except as needed to use the Service in accordance with these Terms.

Some features of the Service may be offered free of charge or on a paid basis. If paid plans are introduced, pricing, billing cycles, and refund terms will be presented before purchase. We may change pricing with reasonable notice where required.

You are responsible for any taxes associated with your use of paid features, unless stated otherwise.

The Service integrates with third-party providers such as Auth0, OpenAI, and Cartesia. Your use of those services may be subject to their separate terms and policies. We are not responsible for third-party services outside our reasonable control.

Our collection and use of personal information is described in our Privacy Policy and Cookie Policy. By using the Service, you consent to those practices.

You may stop using the Service at any time and may request account deletion by contacting support@kjek.com.

We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if continued provision of the Service to you creates risk for us or others. Upon termination, your right to use the Service ceases, but sections that by their nature should survive will remain in effect.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE OR RELIABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KJEK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless Kjek and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Delaware, unless applicable law requires a different forum. You and Kjek consent to personal jurisdiction in those courts.

We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date. Material changes may be communicated through the Service or by email. Your continued use after changes take effect constitutes acceptance of the revised Terms.
